DMCA Policy

1. Introduction

ShamsGuide (“we”) respects the intellectual property rights of others and expects its users to do the same. Under the Digital Millennium Copyright Act of 1998 (“DMCA”), we will respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent.

2. Reporting Copyright Infringement

If you are a copyright owner, or authorized to act on behalf of an owner of the copyright or of an exclusive right under the copyright and believe that your work has been copied in a way that constitutes copyright infringement, please report your notice of infringement to us by providing our designated copyright agent with the following information:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material;
  4. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address;
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. DMCA Notice & Takedown Procedures

It is our policy, in appropriate circumstances and at our discretion, to disable and/or terminate the accounts of users who repeatedly infringe or are repeatedly charged with infringing the copyrights or other intellectual property rights of others.

3.1 Filing a DMCA Notice

DMCA notices can be sent to our designated copyright agent at:

3.2 Processing of DMCA Notices

Upon receipt of a valid DMCA notice, we will:

  1. Remove or disable access to the allegedly infringing content
  2. Make a reasonable effort to notify the affected user of the removal
  3. Provide the affected user with a copy of the DMCA takedown notice
  4. Provide the affected user with information about filing a counter-notice

4. Counter-Notification Procedures

If you believe your content was wrongly removed due to a mistake or misidentification, you may send us a counter-notification. A valid counter-notification must contain the following information:

  1. Your physical or electronic signature;
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled;
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. Your name, address, telephone number, and email address;
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which we may be found; and
  6. A statement that you will accept service of process from the person who provided notification of the alleged infringement.

5. Processing of Counter-Notifications

Upon receipt of a valid counter-notification, we will:

  1. Promptly provide the original complainant with a copy of the counter-notification
  2. Inform the complainant that we will replace the removed material within 10-14 business days
  3. Replace the removed material within 10-14 business days after receipt of the counter-notification, unless our designated copyright agent first receives notice that the original complainant has filed an action seeking a court order to restrain you from engaging in infringing activity relating to the material on our system or network

6. Repeat Infringers

We maintain a policy to terminate account holders or subscribers who are repeat infringers. A repeat infringer is a user who has been notified of infringing activity multiple times and/or has had user content removed from our service multiple times.

7. Modifications to Policy

We reserve the right to modify this DMCA Policy at any time, effective upon posting of an updated version of this Policy on our website. Continued use of our website after any such changes constitutes your acceptance of the new DMCA Policy.
